WINONA -- Judge Alan D. Lancaster dismissed a residential burglary after there wasn’t enough evidence to turn the case of a Winona woman over to the action of the Montgomery County Grand Jury.
Denesha Garrett was charged with burglary, but the charges were dismissed after a positive ID could not be made by the victim or from surveillance video.
After an exchange of if he had evidence or not, the victim said two Winona officers had footage of the incident. When Lancaster asked them about the footage, one of the officers showed him the video and told him it was hard to determine who was pictured in the footage.
Lt. Bryant Bell said the other person mentioned, who is a juvenile, was brought in for questioning and denied any involvement. Lancaster agreed that the height, build, size, and even the hairstyle of the person on the video looked similar to Garrett, but dismissed it without prejudice stating there was no way to positively ID her.
“You can take it to the District Attorney’s office and see how they want to proceed but I can’t bound her over because I can’t see if it’s really her or not,” Lancaster said.
