Supreme Court Justice Samuel Alito is being asked to recuse himself from any cases involving Donald Trump after it was revealed that an American flag flew upside down outside Alito’s house less than two weeks after the 2021 assault on the U.S. Capitol.
Alito attributed the gesture — adopted by Trump’s supporters as a sign of their allegiance to the challenge of his 2020 loss — to his wife, Martha-Ann. He said the upside-down flag was raised in response to a dispute with a Trump-hating neighbor.
If that’s true, Mrs. Alito showed terribly poor judgment. Her husband has been an appellate judge since 1990. Over the last 30-plus years, surely she got the word that bias — or even just the appearance of it — is be avoided at all costs by a jurist. That goes, too, for those with whom the jurist lives.
How could she forget that?
