Eminent domain topic of closed session

The Carroll County Board of Supervisors met behind closed doors Monday concerning an eminent domain matter with one Carroll County resident.

County leaders met with Darryl Barrett of County Road 183 in Beat 3 to discuss his property that is needed for a county bridge project.

According to Carroll County Chancery Clerk Sugar Mullins, no decision was made in executive session.

Chancery Clerk Sugar Mullins said land involved in the project has already been taken through eminent domain proceedings, and the county can go ahead with the project. But the county may have to go to court to negotiate payments to landowners for the property in the last two cases.

"The board made an offer, and the landowner didn't take it," Mullins said.

According to Mullins, there will be 10 days for the landowner to answer the eminent domain complaint.

"The question is how much he [Barrett] accepts," Mullins said.

According to board attorney Kevin Horan, the county has made agreements to purchase land from 10 landowners needed in the bridge project, but may have to go to court to settle with two of the 10.

Prior to going into executive session, Barrett spoke a few words about the matter.

"I wanted to come before the board since the county is going to litigate," Barrett said.

Soon after, Horan said he thought the matter should be heard in executive session.

In other business, the board voted unanimously to receive a report on checks that did not appear on the claims docket.

A motion was made by Beat 3 supervisor Marvin Coward that was seconded by Beat 5 supervisor Rickie Corley.

Mullins informed the board that sometimes checks that were written for bills had to be paid at a certain time, before penalties. Mullins said they were placed in the board's minutes.
